Welcome to Leafy! These Terms of Use ("Terms") govern your use of the Leafy mobile application ("the app"), available for Android and iOS. Leafy is developed and operated by an independent developer based in Lithuania.

By using Leafy, you agree to these Terms. If you do not agree, please do not use the app.

1. About Leafy

Leafy is a plant management application that helps users organize their gardens and care for their plants. The app allows you to create multiple gardens, add plants and photos, create individual plant care plans, track care activities, and receive reminders.

Some features are available for free, while additional functionality may require a Premium purchase. The availability of features may change as the app evolves.

2. Eligibility and acceptable use

Leafy is intended for a general audience and is not specifically directed at children. If you are under the age required to enter into a binding agreement in your country, you should use the app with permission from a parent or legal guardian.

You agree to use Leafy lawfully and not to interfere with its operation, bypass purchase restrictions, misuse its services, or attempt unauthorized access to its systems.

3. Plant information and reminders

Leafy provides tools to help you organize plant care, including watering schedules, care plans, and reminders. Any plant care information or suggestions are provided for general informational purposes only.

Plant care requirements vary depending on the species, environment, climate, and individual conditions. We cannot guarantee that following a care plan or reminder will keep a plant healthy.

Notifications and reminders depend on your device settings, operating system, permissions, and other technical factors. We cannot guarantee that every reminder will be delivered at the intended time.

4. Free version and advertisements

Leafy offers a free version supported by advertisements provided through Google AdMob. Advertisements may be displayed while using the free version of the app.

You may be able to manage your advertising consent and preferences within the app, depending on your location and applicable requirements. Changing advertising consent does not necessarily remove advertisements, but may affect how they are selected.

Advertisements and third-party products or services are provided by their respective advertisers. We are not responsible for the content, availability, or practices of third-party websites or services, except where required by applicable law.

5. Premium features and purchases

Leafy offers optional Premium access through in-app purchases. Premium removes advertisements from the app and unlocks additional features described on the purchase screen.

Prices, included features, and applicable purchase conditions are displayed before you confirm a purchase. Payments are processed through Apple App Store or Google Play, depending on your device, and are subject to the applicable store's payment terms.

Premium access is associated with a valid purchase entitlement. Availability across devices, purchase restoration, and continued access depend on the purchase type, applicable store rules, and supported app functionality.

If a Premium product is offered as a recurring subscription, its price, billing frequency, renewal terms, and cancellation information will be shown before purchase. Subscriptions can be managed through the relevant app store's subscription settings. Uninstalling the app does not automatically cancel an active subscription.

Refunds and withdrawal rights are handled in accordance with applicable consumer protection laws and the relevant app store's procedures. Nothing in these Terms limits your mandatory statutory rights.

6. Your content and local storage

You retain ownership of the plant information, photos, and other content you add to Leafy. You are responsible for ensuring that you have the right to use any images or information you add.

Your gardens, plants, photos, care plans, and related information are stored locally on your device and are not synchronized with our servers.

You are responsible for maintaining appropriate backups of your information. Removing the app, clearing its data, losing your device, or encountering technical problems may result in the loss of locally stored information.

7. Intellectual property

Leafy, including its software, design, branding, interface, and original content, is owned by the developer or its respective licensors and is protected by applicable intellectual property laws.

You receive a limited, personal, non-exclusive, non-transferable license to use the app for lawful purposes in accordance with these Terms and applicable app store rules.

You may not copy, redistribute, sell, or commercially exploit the app or its protected content without permission, except where permitted by applicable law or relevant third-party licenses.

8. Privacy and third-party services

Leafy uses third-party services, including Google Firebase for analytics and crash reporting and Google AdMob for advertisements. These services may process certain technical information as described in our Privacy Policy.

9. Availability and changes

We aim to keep Leafy available and functioning properly, but cannot guarantee uninterrupted or error-free operation. Features may be updated, improved, modified, or discontinued.

We may discontinue the app or parts of its functionality. Where changes materially affect paid digital features, we will comply with applicable consumer protection requirements, including any required notice or remedies.

10. Disclaimer and liability

Leafy is provided for personal plant organization and care assistance. We make reasonable efforts to maintain the app, but do not guarantee specific plant care outcomes, uninterrupted operation, or error-free reminders.

To the extent permitted by applicable law, we are not responsible for losses caused by incorrect plant care decisions, missed reminders, or circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

11. Ending your use of Leafy

You may stop using Leafy at any time by uninstalling the app. If you have an active subscription, you must cancel it separately through the relevant app store to prevent future renewal charges.

We may restrict access to features where reasonably necessary to address unlawful use, security risks, or violations of these Terms, subject to applicable law.

12. Governing law

These Terms are governed by the laws of the Republic of Lithuania. If you are a consumer residing in another country, you retain the protection of any mandatory consumer laws applicable to you.

Any disputes will be handled in accordance with applicable law and consumer dispute resolution rules. You may contact us first to seek an amicable resolution.

13. Changes to these Terms

We may update these Terms to reflect changes to the app, its features, or legal requirements. The updated version will be published with a revised date. Material changes will be communicated where required by applicable law.
